1. Information on the processing of personal information

The purpose of this document is to provide information on the rights and contexts related to the processing of personal data by ESKO generator s.r.o., ID 07818025, with its registered office in Záhumenní 2034/103, 708 00 Ostrava Poruba, Czech Republic, entered in the Commercial Register kept by the Municipal Court in Ostrava, Section C, Insert 77342 (hereinafter also “Controller“), in accordance with Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (General Data Protection Regulation), as well as in accordance with Act No. 110/2019 Coll. ., on the processing of personal data and Act No. 111/2019 Coll.

Personal data processing means any systematic operations with personal data of the Personal Data Processing Subject (eg customer, job seeker, etc.) – in particular, the collection, storage, making available, modification or modification, retrieval, use, transmission, dissemination, publication, storage, exchange, sorting or combination, blocking and disposal.

Personal data can be processed by either the Controller or the Processor. The Controller of personal data is a legal entity that determines the purpose of processing personal data and is responsible for it. The Processor is a natural or legal person who processes personal data on the basis of a contractual relationship with the Controller.

In the following chapters you can find information on what personal data we collect as a Controller, how we handle them, where we obtain them from and what basic rights in the field of personal data protection you can exercise as a Personal Data Processing Subject. The information also concerns, for example, potential clients, suppliers or future employees with whom ESKO generator s.r.o., has not yet concluded a contractual relationship, but is negotiating its conclusion, or former clients for whom ESKO generator s.r.o. has a legitimate reason to process personal data, website visitors or other ESKO generator s.r.o. electronic platforms.

2. Types of personal data and methods of their processing

The Controller processes personal data only for clearly and comprehensibly defined purposes, by legal means and for the time necessary with regard to the purpose of processing.
It processes accurate personal data and only to the extent that is necessary for the fulfillment of contractual obligations, resp. to fulfill the purpose for which the personal data are processed. The Controller continuously assesses whether the need to process personal data for a certain purpose persists, and if such a purpose no longer exists, personal data are destroyed or deleted.

This includes the processing of the following data in particular:

  • Identification and contact data

Identification or contact data are, in particular, name, surname, telephone number, fax number, correspondence address, e-mail or other similar contact information, also the ID number and VAT number of the customer, supplier or other contractual partner of the natural person doing business. This data is obtained by the Controller directly from the Personal Data Processing Subject, or from publicly available sources (eg the Commercial Register, etc.). Another possible identification data is the IP address of the client of the used computer.

  • Personal data

By sending your CV, you voluntarily give the Controller consent to the processing of your personal data stated in the CV, cover letter or other related communication, in order to participate in the selection procedure for the Controller’s job position.

The Controller does not process personal data falling into a special category of personal data, so-called sensitive data (data on racial or ethnic origin, data on religious or philosophical beliefs, data on health status or sexual life or orientation) unless required by law.

3. Purposes and legal bases for personal data processin

The Controller processes personal data only for clearly and comprehensibly defined purposes, which include in particular:

  • Performance of the contract

The Controller is entitled to process identification and contact data for the purpose of concluding and fulfilling the contract, even without the consent of the Personal Data Processing Subject. The Controller retains your identification data for the period specified by applicable law.

  • Business and marketing purposes

The Controller is entitled to process your contact details for business and marketing purposes with your consent. Consent is not required when the Controller processes the contact details of its customers within the legitimate interest for the purpose of so-called direct marketing (eg business messages sent by e-mail, customer satisfaction survey).

Consent to the processing of contact details for business and marketing purposes is voluntary and remains valid until you revoke it. You are entitled to revoke this consent at any time by replying to the business message sent or by using the contacts listed in Article 1 of this document.

  • Participation in the competition for the job position

Based on your consent, the Controller is entitled to process your personal data for the purpose of participating in the competition for a job held for the Controller. Based on the consent given, the Controller is also entitled to keep your contact and personnel data in the Controller’s personnel database.

Consent to the processing and storage of your personal data is voluntary. You give this consent for a period of one year from the submission of the data. You are entitled to revoke this consent at any time through the contacts listed in Article 1 of this document.

4.   Cookies

This section describes the use of cookies used by the Controller on its website www.eskogenerator.cz. It provides an explanation of what cookies are, what they are used by the Controller, how to accept, modify or reject them.

  • Cookies

Cookies are short text files that the visited site sends to your browser. They allow you to record information about your visit (eg preferred language, device used and other settings). This may make it easier for you to visit the site the next time. If you have cookies enabled in your web browser, the Controller may process records of your behavior on the website in order to analyze and improve the operation of this website.   • Types of used cookies and their use

The Controller of www.eskogenerator.cz uses cookies, which can be divided according to their period of validity or according to purpose.

Short-term cookies – valid for the duration of your visit and expire after leaving the site. They help the basic functions of the site.

Long-term cookies – are valid for several months and facilitate a possible return to the site.

Necessary technical cookies – are necessary for the proper functioning of the website and all the functions it offers (site navigation, language selection, login to the secure part). Without these cookies, the website will probably not work properly. Therefore, we do not recommend disabling these cookies due to the risk of limiting the availability of services that you expect from this site. These cookies do not store any personally identifiable information.

Analytic cookies – allow to track the number of visitors and traffic sources through Google Analytics, which helps us improve site performance. We can use them to determine which sites are most useful to you. All information that cookies collect is aggregated and anonymous.

  • Rights in connection with use of cookies

Even in connection with the processing of cookies, you have the opportunity to use your rights for the processing of personal data, which are described in Chapter 7. Rights of Subjects.

5.   Transfer of personal data to third part

All personal data obtained from Personal Data Processing Subjects is used by the Controller exclusively for internal use. However, the Controller is entitled to transfer personal data of the Personal Data Processing Subject to third parties in the following cases:

  • subcontractors (eg contact details of the customer for the purposes of transport or commissioning of products and services ordered by the customer),
  • legal representatives, courts for the purpose of enforcing or concluding any contract with the Personal Data Processing Subject,
  • public authorities on the basis of a legal obligation (eg the Police of the Czech Republic). 

6.   Security of personal data

Personal data is processed by the Controller in the Czech Republic. The Controller uses appropriate organizational and technical measures to protect personal data from loss, manipulation and unauthorized access.

7.   Rights od Personal Data Processing Subjects

  • Access to information

The natural right of the Personal Data Processing Subject is the right to obtain information about its personal data that the Controller processes about it (purpose, type of data, processing time, etc.).

  • Correction of personal data

The Personal Data Processing Subject has the right to correct its personal data processed by the Controller in the event that they are inaccurate or out of date.

  • Deletion of personal data

He may also exercise the right to delete his personal data, provided that they are no longer needed for the purpose for which they were processed and with the exception of personal data processed for the purpose of fulfilling the legal obligations or legitimate interest of the Controller.

  • Restrictions on the proccesing of the personal data

The Personal Data Processing Subject also has the right to limit the processing of its personal data by the Controller, eg in the event that:

– are inaccurate,

– the Controller no longer needs them for processing purposes, however a third party requires them to determine, enforce or defend legal claims.

  • Raise an objection

The Personal Data Processing Subject also has the right to object to the processing of his personal data.

  • Notification of correction, deletion or restriction

The Personal Data Processing Subject also has the right to be notified of the correction, deletion or restriction of the personal data processed.

  • The right to provide and transfer personal data

The Personal Data Processing Subject may exercise the right to provide data processed about it by the Controller. The Personal Data Processing Subject may also request the Controller to transfer its personal data to another Controller, in a structured, commonly used and machine-readable format, to the extent of the data provided by the Personal Data Processing Subject to the Controller.

  • The right to withdraw consent

In the event that personal data are processed on the basis of the consent granted by the Personal Data Processing Subject, the Personal Data Processing Subject has the right to revoke this consent at any time. However, the revocation of the consent has no effect on the processing of personal data on other legal grounds, nor on the processing of personal data for as long as the consent of the Personal Data Processing Subject was valid.

All the above rights can be exercised with the Controller at the address of the company’s premises: ESKO generator s.r.o, Záhumenní 2034/103, 708 00 Ostrava Poruba, Czech Republic, by e-mail at info@eskogenerator.cz or by phone at +420 724 898 469. In the event that The Personal Data Processing Subject shall exercise the rights mentioned above, the Controller has the right and obligation to unambiguously identify such an applicant. If the Controller deems it necessary from the point of view of privacy protection, he may request the applicant to provide additional information necessary to verify his identity. Without sufficient identification of the applicant, the Controller may reject the application. It may also reject requests that are disproportionately repetitive or manifestly unfounded.

In the event that the Personal Data Processing Subject considers that the processing of its personal data by the Controller is in conflict with the relevant laws on personal data protection, it may file a complaint with the Office for Personal Data Protection (www.uoou.cz).

These Privacy Policy is valid and effective as of 1.2.2023.
